Plan2BOQ — Terms of Service
Effective date: 19 October 2026
Version: 1.1
1. About Plan2BOQ
Plan2BOQ is construction estimating, digital takeoff and Bill of Quantities software operated by Jason Bunney, a New Zealand sole trader based in Manawatū, New Zealand.
These Terms of Service govern access to and use of the Plan2BOQ Suite, including its desktop software, licensing services, free trials, paid subscriptions, updates and technical support.
By registering for, activating or using Plan2BOQ, you agree to these Terms of Service.
If you do not agree to these Terms, you must not register for or use the software.
2. Software and Intended Use
Plan2BOQ provides tools to assist with construction measurements, material quantities, estimating, pricing and preparation of Bills of Quantities.
The software performs calculations based on plans, measurements, product selections, pricing information and other information entered or selected by the user.
Users remain responsible for checking the accuracy, completeness and suitability of their inputs and outputs before relying on them for quotations, tenders, purchasing, construction or other decisions.
Plan2BOQ does not guarantee that an estimate or Bill of Quantities will match actual construction costs, site conditions or material requirements.
Nothing in this section removes any rights or remedies that cannot lawfully be excluded under New Zealand law.
3. Free Trial
Plan2BOQ offers a 14-day free trial of the complete Plan2BOQ Suite.
No credit card or payment details are required to begin the trial.
The trial period begins when the desktop software is successfully activated for the first time under the trial licence, rather than when the customer initially registers.
The trial does not automatically convert into a paid subscription.
At the end of the trial, continued use requires an active paid subscription or another valid entitlement authorised by Plan2BOQ.
Free trials are intended for genuine prospective customers. Plan2BOQ may reasonably restrict repeated or fraudulent trial registrations intended to circumvent trial limits.
4. Paid Subscriptions and Payments
Plan2BOQ is offered through recurring paid subscriptions.
The applicable subscription price, billing frequency and any relevant taxes will be displayed before a customer completes their purchase.
Payments are processed securely through Stripe, our third-party payment provider.
Plan2BOQ does not directly receive or store full payment-card numbers or card security codes.
Subscriptions renew automatically according to the billing period selected by the customer unless cancelled before renewal.
Customers authorise recurring charges by completing the applicable Stripe subscription checkout process.
We may change subscription prices from time to time. Where a change affects an existing subscription, we will provide notice as required by applicable law and the relevant subscription arrangements.
5. Cancellation and Refunds
Customers may cancel a paid subscription at any time through the available Stripe Customer Portal or by contacting Plan2BOQ support.
Cancellation stops future subscription renewals.
Unless otherwise stated or required by law, access to the paid software continues until the end of the current paid billing period.
There is no additional cancellation penalty.
Cancellation does not automatically entitle a customer to a refund for unused time within an already-paid billing period.
Refund requests will be considered in accordance with applicable New Zealand law and the circumstances of the request.
Nothing in these Terms limits any refund, cancellation or other remedy that a customer is legally entitled to receive.
6. Software Licensing and Authorised Use
Plan2BOQ is licensed to customers for use under an active free trial, paid subscription or another entitlement expressly authorised by Plan2BOQ.
The software is licensed, not sold.
Customers receive a limited, non-exclusive and non-transferable right to use the software in accordance with their valid entitlement and the applicable licence conditions.
Customers must not:
-
Circumvent or interfere with licensing, activation or security controls.
-
Share or transfer licence credentials in a manner inconsistent with their authorised entitlement.
-
Attempt to gain unauthorised access to Plan2BOQ services or customer accounts.
-
Copy, redistribute, resell or commercially exploit the software without permission.
-
Reverse-engineer the software except where expressly permitted by applicable law.
Plan2BOQ may suspend or restrict access where reasonably necessary to address fraud, unauthorised use, security risks or a material breach of these Terms.
Where reasonably practicable, customers will be given an opportunity to resolve an issue before access is restricted, unless immediate action is required for security or legal reasons.
7. Customer Projects and Data
Plan2BOQ is designed to operate as desktop software.
During normal use, customer drawings, digital takeoffs, estimates, Bills of Quantities, merchant price files and project files remain on the customer's own computer.
The Plan2BOQ onboarding and licensing services do not ordinarily receive or store these project files.
Customers retain ownership of the project information and files they create or import.
Customers are responsible for maintaining appropriate backups of their locally stored project files and protecting their computers against loss, damage or unauthorised access.
Where a customer voluntarily provides project files, screenshots or other information for technical support, Plan2BOQ will use that information for the relevant support purpose and handle personal information in accordance with its Privacy Policy.
Software updates are intended to preserve existing customer project information. However, customers should maintain backups before installing updates or making significant system changes.
8. Accuracy and Professional Responsibility
Plan2BOQ is an estimating and quantity-calculation tool. It does not replace professional judgement, construction knowledge, independent verification or appropriate site inspections.
Customers are responsible for confirming that:
-
Plans and measurements are accurate and current.
-
Appropriate materials, products and construction methods have been selected.
-
Merchant pricing and other cost information are correct and up to date.
-
Estimates and quantities are suitable for the intended project.
-
Final outputs comply with applicable contractual, regulatory and professional requirements.
Customers should independently verify significant quantities, costs and assumptions before issuing quotations, submitting tenders or committing to purchases.
9. Software Updates and Availability
Plan2BOQ may release updates to improve functionality, correct faults, address security issues or maintain compatibility.
Some updates may be necessary for continued access to licensing or other connected services.
We aim to maintain reliable software and licensing services but cannot guarantee uninterrupted or error-free availability.
Temporary interruptions may occur due to maintenance, technical faults, internet connectivity, third-party services or circumstances beyond our reasonable control.
We will take reasonable steps to address faults and service interruptions.
Nothing in this section excludes any obligations or remedies that apply under New Zealand law.
10. Technical Support
Plan2BOQ provides technical support through:
Normal support hours are 8:00 am to 5:00 pm, New Zealand time.
Support outside these hours may be available by arrangement.
Remote technical assistance may be offered where appropriate. Customers must expressly authorise remote access or screen-sharing before any remote support session begins.
Customers should close or protect confidential information that is not relevant to the support request.
Support availability and response times may vary depending on the nature of the issue and operational circumstances.
11. Privacy and Security
Plan2BOQ collects and processes limited customer information required for registration, email verification, licensing, subscriptions, security and technical support.
Personal information is handled in accordance with the Plan2BOQ Privacy Policy and applicable New Zealand privacy legislation.
Customers are responsible for protecting their own email accounts, computers, local project files and any licensing credentials provided to them.
Customers should promptly contact Plan2BOQ if they suspect unauthorised access or misuse of their licence.
12. Intellectual Property
The Plan2BOQ software, its underlying code, calculation engines, design, branding, documentation and associated intellectual property remain the property of Plan2BOQ or the relevant rights holders.
Purchasing a subscription or activating a free trial does not transfer ownership of the software or its intellectual property.
Customers retain ownership of their own drawings, project information, estimates, pricing files and other content created or imported through authorised use of the software.
Customers must not use Plan2BOQ branding, software or documentation in a manner that falsely implies endorsement, partnership or ownership.
13. Liability and Consumer Rights
Plan2BOQ is intended for construction estimating and related business or professional use.
Users are responsible for reviewing their inputs and verifying estimates, quantities and Bills of Quantities before relying on them for commercial or construction decisions.
To the extent permitted by law, Plan2BOQ is not liable for losses arising from inaccurate information supplied by users, incorrect interpretation of plans or reliance on unverified estimates.
Nothing in these Terms excludes, restricts or modifies any rights or remedies under the Consumer Guarantees Act 1993, Fair Trading Act 1986 or other applicable New Zealand legislation where those rights or remedies cannot lawfully be excluded, restricted or modified.
14. Changes to These Terms
Plan2BOQ may update these Terms of Service to reflect changes in the software, subscription arrangements, legal requirements or business operations.
The current version and effective date will be displayed on the Plan2BOQ website.
Where changes materially affect existing customers, we will provide reasonable notice as appropriate and required by law.
Changes will not remove rights that customers have already acquired under applicable law.
15. Governing Law
These Terms of Service are governed by the laws of New Zealand.
Any dispute arising from the use of Plan2BOQ will be subject to applicable New Zealand law and the jurisdiction of the relevant New Zealand courts, subject to any mandatory legal rights or protections that apply.
